It has been belatedly revealed that actor Jung Yunho fainted during a shooting.

On the 12th, Jung Yunho's facial muscles contracted during the shooting and he was rushed to the hospital.

The three members of group TVXQ who have unfair contract dispute with their agency SM Entertainment presented at the court secretly on last October 13th, however had failed to reach agreement with SM. Previously on October 12th, the two side had submitted a final official stand documents that have been required since early this month for review to make final decision.


At the end of July this year, 3 TVXQ members (Jaejoong, Yoochun, and Junsu) filed their disposition application to Seoul Central District Court to terminate the exclusive contract effect against SM Entertainment. Reprortedly on July 30th at 4 pm, wearing sunglasses, the members entered hurriedly to the side entrance of the court building. They secretly received report about the trial request date and other information regarding the case was not disclosed. There was no appearance of the fans, and even most of court staffs couldn’t recognize the three members who disguised themselves just like ordinary civilians and they could move without any fuss.

On August 22nd the legal representative of the 3 members forwarded members’ thought to the court, “We found it very difficult to improve and reach our goals in this industry if we live under SM’s management with all its terms and conditions.”. It’s also reported that, “The arguments happened with SM Lee Soo Man regarding this dispute already reached our highest limit of emotion.” Meanwhile the other two members who don’t participate in the legal case and still have listed activities with SM said, “It’s not possible to breakdown a group of 5 people who actually still want to work together.” showing their intention to keep shinning together as a group.

After the failure of yesterday’s mediation between two sides, court won’t summon the 3 members any further and will make its final decision soon.

DongBangShinKi attended the court for an agreement but failed.

TVXQ’s Hero Jaejoong, Micky Yoochun, Xiah Junsu submit today in court, despite the court’s mediation efforts to reach a consensus.

In the past three months, DBSK members and SM Ent attended at the Seoul Central District Court to coordinate the process of the case. The court agreed that both sides should come up with an amicable decision but because of the differences between each other, the agreement did not end the conflict.

For TVXQ “They have the deep feeling that their goal which is changing their work conditions seems to be difficult to reach”.

The court is planning to make a difficult decision for both sides later in the month.

Meanwhile last July 31st, the 3 members of Dong Bang Shin Ki 3 filled an exclusive contract validity suspension and provisional disposition request.

「One of Asia’s biggest group Dong Bang Shin Ki (DBSK), has 3 of its members in a possible lawsuit against their own company SM Entertainment. DBSK members Xiah JunSu, Micky YooChun and Hero JaeJoong had gone to Seoul Central District Court to hand in an application for provisional disposition to terminate all effects of their exclusive belonging rights contract with SM on 31st July. This raised concern among fans about the group’s potential break up. By hearing this out breaking news, overseas fans have put their efforts into an international project. A DBSK’s overseas fan who’s the mastermind of this project has created a channel at YouTube and posted the video by 21st of September entitled, “동방신기 DBSK International Fansong Project 2009”.

In accordance to the current dispute between five member group TVXQ and their agency regarding their exclusive contract, fans have submitted petitions asking the Courts to stop the disbandment of the group.

According to the Seoul Disctrict Courts, Ms. J, who identified herself as a TVXQ fan, submitted a petition under her name that included the signatures of fans; her second one after the first that was submitted on the 15th.

However, Ms J is not the only one to do so. As soon as the lawsuit between TVXQ and their agency was publicized by the media, the fans have been continually submitting petitions to the Courts.

Soon after the dispute was known by the media, Ms. Y submitted numerous petitions made by TVXQ fans on August 20th. On the 8th this month, Ms. K, Ms.C and Ms. Y gave the Courts more petitions that were comprised of signatures of fans. All of these documents are physical proof of the hearts of the fans who do not want TVXQ to disband.

As the document submission for both sides has already ended on the 11th, both sides have stated, "We cannot talk about the details of the consensus both sides were attempting to reach as the court decision has not been made," and "Since this is a very sensitive subject, we will have to approach it carefully."

Sejong Law Firm, that is representing the three members (Jaejoong, Yoochun and Junsu) of TVXQ, stated to a StarNews reporter today that, "All documjents from both sides have been submitted. All there is left is the Court's verdict" and "As this is a suspension request, the verdict date was not set at the beginning so we don't know when the verdict will come. We are waiting nervously for the results."

SM Entertainment (hereafter SM) filed a request to the court to cancel the submission of “preservation of evidence” application as being requested by TVXQ members Hero Jaejoong, Micky Yoochun, and Xiah Junsu, however, the request was rejected.

One of the litigants through a phone call with Money Star News on the 23rd said, “On last 18th, the court rejected SM’s cancellation request of evidence preservation. Claimant side’s, the three TVXQ members, preservation of evidence application is still up and will receive document submission related to earnings from SM.”

The Seoul Central District Court prosecutor explained the reason of the rejection, “The fact which has been drawn up is about legal relationship between the artists and their agency company, and in compliance with law of civil procedure article 2 section 344, the document holder side couldn’t refuse to submit the documents that become object of document submission order assertion from the complainants.”

On August 5th, Jaejoong, Yoochun, and Junsu side submitted a preservation of evidence to the court to calculate the real income distribution of all TVXQ activities from SM Entertainment. The preservation of evidences demanded including accounting books, contracts, receipts, journals, and any relevant documents related to the income distribution calculation.

With the court rejection, seems that the document release by SM is now inevitable.

Currently both sides of SM and 3 TVXQ members has now been waiting for the court decision after the first hearing on 21st last month.

Action Packed Scenes in “Heading to the Ground” by Jung Yunho and Ara

MBC’s drama “Heading to the Ground” that airs Wednesdays and Thursdays, attracted the attention this week with its action movie-like scenes.

The episode of “Heading to the Ground” that aired September 17th left many clutching on to the edge of their seats, featuring a thrilling motorcycle chase that was followed by a car crash.

In this episode, Bong-goon ( Jung Yunho) speeds down the freeway on a motorcycle, in a dangerous pursuit of the kidnapped Hae-Bin (Ara). Eventually, in jumping on to the car in order to save Hae-bin from falling into Lake Han, he does so himself after he manages to gets her to safety.

After the filming crew managed to block off the entire bridge from the public with a single car, Jung Yunho and Ara set about displaying a flawless performance of a very difficult and dangerous scene.

This scene also was the subject of much discussion as it took place in the midst of Yunho’s 4000 fans that had been invited to fill the audience stands during the fliming of Cha Bong-goon’s soccer debut scene.

On September 30th the two members will release a single in Japan entitled COLORS ~ Melody & Harmony ~. This is the first duet album of small group contains Micky Yoochun and Hero Jaejoong after 5 years of TVXQ debut in Japan. In a phone conversation with Newsen on the 15th, the Courts stated, “Both sides submitted all relevant documents by September 11th. A second song, SHELTER, from the Colors ~Melody & Harmony~ Single has been announced.

According to recent magazine interview (T/N: which one is not mentioned), SHELTER was a joint composed song of Jaejoong and Junsu.

The song was made in South Korea, and while Jaejoong was working on it, all of sudden Junsu came in interrupting him with all his spontaneous idea and they both ended up composing the song together and ignored all the commonness way in writing a song.

Lyrics was written by Yoochun and HUB. Yoochun wrote the rap part, and the song itself has R&B feel and dance tune in it.
